Important Regulation Dates Pushed Backed

The Department of Transportation has pushed back the publication dates for multiple important trucking regulations, all predicted to be published this year. See the new expected dates below.

This year is full of assumed governing actions for the trucking industry, some of which have not been applauded by those bound to be affected. Fortunately, the Department of Transportation has suspended the publications of many propositions, giving carriers and drivers a little more time to express their feelings toward the fresh rules. Here are the regulations the Federal Motor Carrier Safety Administration has pushed back along with their newly expected publication dates.

Electronic Logging Device Mandate 
  • New expected publication date: Nov. 9, 2015
  • Delay: 6 weeks 
  • Effective date: 2 years after publication
  • Purpose: Mandate that drivers must use electronic logging systems versus paper logging to confirm compliance.
Speed Limiter Mandate
  • New expected publication date: June 8, 2015
  • Delay: 1 month
  • Effective date: Sometime after a public comment period
  • Purpose: Require trucks weighing more than 26,000 pounds to install a speed limiter or "governor", which enforces a national speed limit.
CDL Drug and Alcohol Clearinghouse
  • New expected publication date: Dec. 14, 2015
  • Delay: 6 weeks
  • Effective date: 18 months after publication in the Federal Register
  • Purpose: Institute a database of drivers who have failed or refused to take drug or alcohol tests, which will assist carriers when hiring.
Safety Fitness Determination
  • New expected publication date: July 1, 2015
  • Delay: 2 weeks
  • Effective date: 60- 90 days after publication
  • Purpose: Allow FMCSA to use ratings from CSA's Safety Measurement System BASICs, investigations and inspections to produce an absolute safety score for trucking companies.
Prohibition of Driver Coercion
  • New expected publication date: Sept. 10, 2015
  • Delay: None
  • Effective Date: Upon publication
  • Purpose: Impose penalties on carriers, shippers, brokers or other individuals who coerce truck operators to violate federal safety rules.
